66 <br /> MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, JULY 13, 1976. <br /> A special meeting of the Leesburg Town Council was held on July <br /> 13, 1976 at 7 : 30 P.M. in the Council Chambers , 10 West Loudoun Street, <br /> Leesburg, Virginia, notice thereof having been mailed to all Council <br /> members prior to the meeting. Acknowledgment of said notice was made <br /> by all members present and a copy of said Notice and acknowledgment <br /> is on file in the office of the Clerk. Present were: Mayor Mary <br /> Anne Newman, Councilmembers Charles E. Bange, Glen P. Cole, Stanley <br /> D. Herrell , Jr. and C. Terry Titus ; also Town Manager John Niccolls <br /> and Assistant to the Manager Jeffrey H. Minor. Absent from the <br /> meeting was Councilman James A. Rock. <br /> The meeting was called to order by Mayor Newman, who stated <br /> that the purpose of this meeting is to consider the immediate con- <br /> nection of the J. Lupton Simpson Middle School to the Leesburg sewer <br /> system. This meeting is being held tonight in order that it will <br /> coincide with the School Board meeting, which is now in session. <br /> On motion of Mr. Bange, seconded by Mr. Herrell , the following <br /> resolution was proposed: <br /> 76-103 - Resolution - Authorizingconnection and use of the J. Lupton <br /> Simpson Midle School Trunk Sewer Line. <br /> WHEREAS, the Loudoun County Public Schools has requested <br /> connection and use of the J. Lupton Simpson Middle School <br /> trunk sewer line; <br /> • <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the Town <br /> ' of Leesburg, Virginia, as follows: <br /> That the manager is hereby authorized and directed to per- <br /> mit connection and use of the J. Lupton Simpson Middle <br /> School to the town' s sewer system under the following con- <br /> ditions : <br /> A. That such permission shall be granted without prejudice <br /> to the town' s right to collect availability fees in <br /> line with Section 15-14 of the Code. <br /> B. That such permission does not authorize acceptance of <br /> the J. Lupton Simpson Middle School trunk line into <br /> the town s sewer system. <br /> It was felt that the above resolution is in order and in the best <br /> interest of the citizens, with the exception of Mr. Titus, who said <br /> he would not be voting on this matter due to the fact that he has <br /> done prior work for the contractor on this project. Mr. Titus also <br /> voiced his objections to Council taking action on this matter when <br /> Mr. Rock is not present. Mayor Newman advised that she had set this <br /> meeting for tonight, rather than this afternoon, because she was ad- <br /> vised that Mr. Rock would be back this afternoon. <br /> A roll call vote on the above resolution was 4 to 1 abstention, <br /> as shown: <br /> Aye: Councilmembers Bange, Cole, Herrell and Mayor Newman. <br /> Nay: None. <br /> Abstention: Councilman Titus. <br /> On motion of Mr. Titus, seconded by Mr. Bange, Council voted <br /> unanimously to go into executive session to discuss legal matters at <br /> 7 : 37 P.M. Council reconvened at 9 : 21 P.M. , with no action taken. <br /> On motion of Mr. Bange, seconded by Mr. Cole, the meeting was <br /> adjourned. <br /> (?
