1 16 <br /> MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, OCTOBER 13, 1976. <br /> A regular meeting of the Leesburg Town Council was held in the <br /> Council Chambers, 10 West Loudoun Street, Leesburg, Virginia, on • <br /> October 13, 1976 at 7 : 30 P.M. The meeting was called to order by <br /> the Mayor, with the invocation being offered by Mr. Cole, and fol- <br /> lowed with the Salute to the Flag. Present were: Mayor Mary Anne <br /> Newman, Councilmembers Charles E. Bange, Glen P. Cole, Stanley D. <br /> Herrell , Jr. , James A. Rock, C. Terry Titus and John W. Tolbert, Jr. ; <br /> also Town Manager John Niccolls , Assistant to ,Town Manager Jeffrey H. <br /> Minor and Town Attorney George M. Martin. <br /> The minutes of regular meeting of September 22, 1976 and special <br /> meeting of September 28, 1976 were approved as written. <br /> Mayor Newman presented to Mr. Dick A. Richards a Certificate of <br /> Appreciation for his ten years of service as a member of the Leesburg <br /> Board of Architectural Review. Mr. Richards -responded with appre- <br /> ciative remarks. <br /> • <br /> 76-0-19 - Ordinance - Regarding the dissemination of criminal history <br /> record information for the purpose of general <br /> investigation of applicants for municipal em- <br /> ployment. <br /> On motion of Mr. Bange, seconded by Mr. Cole, the following ordi- <br /> nance was proposed and unanimously adopted: <br /> BE IT ORDAINED by the Council of the Town of Leesburg, Vir- <br /> ginia, as follows : <br /> SECTION I. That the Town Code is hereby amended by adding <br /> a new section to be numbered Section 14-7 , which shall read <br /> as follows: <br /> Sec. 14-7. Officers to provide record information of <br /> applicants for municipal employment. <br /> (a) As used in this section the words "criminal his- <br /> tory record information" shall mean records and data collected <br /> by Criminal Justice Agencies on adult individuals consisting of <br /> identifiable descriptions and notations of arrest, deten- <br /> tions, indictments, informations, or other formal charges, <br /> and any disposition arising therefrom. The term shall not <br /> include juvenile record information which is controlled by <br /> Chapter 8 of Title 16. 1 of the Code of Virginia. <br /> (b) The chief of police, police clerk and such other <br /> police officers as the chief of police may designate are <br /> authorized and directed to furnish criminal history record <br /> information to individuals authorized by the town tanager <br /> to perform personnel functions, for use during general in- <br /> vestigations of applicants for employment by the municipality, <br /> to determine if the past criminal conduct of such applicants <br /> is compatible with the nature of the employment. <br /> SECTION II. That an emergency exists' and this ordinance shall <br /> be in full force and effect from and after- its passage. <br /> iv <br /> Aye: Councilmembers Bange, Cole, Herrell , Rock, Titus, Tolbert <br /> and Mayor Newman. <br /> Nay: None. <br /> 76-158 R Resolution - Revising the Leesburg Personnel Manual by in- <br /> corvoratin a posifion classification for the <br /> position of Parking Meter Attendant. <br /> On motion of Mr. Cole, seconded by Mr. Herrell, the following <br /> resolution was proposed: <br /> BE IT RESOLVED by the Town Council of the Town of Leesburg, <br /> Virginia, as follows : <br /> That an additional position classification is hereby added <br /> to the Leesburg Personnel Manual for the position of Parking <br /> Meter Attendant to be shown on page 50-A to read as follows: <br />
